Under our present state of the law, to be qualified as an elective local official, one must be a registered voter in the barangay, municipality, city or province, or in case of a member of sangunian (panlalawigan, panlunsod or bayan), a registered voter in the district where he intends to be elected and a resident therein for at least one year immediately preceding the election. Kasta met ti requirement pag congressman. Pag senator, two years ang residency reqt. Pag president, ten years ang residency reqt and both require that one must be a registered voter.


It is doctrinally settled that the term ?residence,? as used in the law prescribing the qualifications for suffrage and for elective office, means the same thing as ?domicile,? which imports not only an intention to reside in a fixed place but also personal presence in that place, coupled with conduct indicative of such intention. ?Domicile? denotes a fixed permanent residence to which, whenever absent for business, pleasure, or some other reasons, one intends to return. ?Domicile? is a question of intention and circumstances.

Thus, pag absentee voter ka, it appears that you are not qualified to run for public office because of the residency requirement as interpreted by the Supreme Court depende sa intention mo in going abroad.

I am into general practice actually. But I am more exposed to civil, commercial and tax laws. Any legal matter will be entertained basta phil. laws lang ha. I am still studying foreign laws esp. that of california laws. I'm dreaming of taking the California Bar in the future (kung makakuha ng visa).

I have a friend in the States....I will name her (CHRISTINA) SHE IS MARRIED TO (DIEGO ).... Christina and Diego are both US CITIZEN.... Prior to the marrIAGE may nabuntisan daw si Diego in the Philippines....(and I will name her ANA) BUT Diego is claiming that he was not the father....(kesyo may boyfriend daw si Ana during that time).....para manahimik ang lahat, when Diego was still single he's been sending support to his "SON".....i think this would show that DIEGO already acknowledged that HE IS THE FATHER...DI BA?????.... The child is now 11 years old....

Her question is:

May karapatan ba si ANA na humingi ng support kay DIEGO legally...LIKE Diego can be GARNISHED automatically from his earnings? In the STATES..

If Diego is not going to give child support ? What's gonna happen?

Christina is very rich, she got a lot of properties in the Philippines, few of these properties were already named under their names (Christina and Diego)....may right ba din ba yung bata sa properties?

Diego's giving of support to his son may be considered as admission/acknowledgment of filiation. Under the law kasi, illegitimate children may establish their illegitimate filiation in the same way and on the same evidence as legitimate children, one of which ( in the absence of record of birth or admission in a public or private handwritten instrument) are those means allowed by the Rules of Court (acts, declarations or ommissions as to a relevant fact may be given in evidence against him).

Ana has no right to ask support from Diego directly, but she may ask support in behalf of his son (if the child is really the son of Diego). Garnishment is not automatic, she must secure a court order on the matter.

If Diego will not give support, Ana may file an action for support here in the Philippines. But Ana must prove by convincing evidence that the child is the son of Diego. This may be proven by DNA test, which is already admissible in evidence in any court of law to prove filiation.

As regards the properties in the Philippines- if proven that the child is an illegitimate son of Diego, said child may be entitled to one half of the share of a legitimate child but the same accrues only upon death of Diego. In case, the action for support will prosper, the properties located in the philippines (owned exclusively by Diego) may be attached if Diego will not comply with the Order of the court directing him to give support to the child. With regard to the properties owned by both Diego and Ana, i think the same cannot be attached considering that the obligation of Diego to give support doesl not redound to the benefit of the family such that the conjugal properties shall answer for said obligation.

Tell your friend not to worry, Ana must first go to court to prove her claim that the child is Diego's son. Thus, Diego may not continue to give support as of this time, unless, for conscience sake, he already acknowledge the child as his. The conjugal properties located in the Philippines can not be attached and Diego's earnings in the states may not be garnished. Ciao!

Diego may be declared as in default and Ana may present evidence ex parte (meaning evidence in behalf of her son without the benefit of cross examination by opposing counsel). The court may acquire jurisdiction over the person of Diego by extraterritorial service. If for any reason, the court grants Ana's petition/action and Diego does not comply, he may be cited in contempt of court but it is impossible for him to suffer the penalty for contempt considering that he is outside the philippines. The Philippine Government has no business over private matters.

As far as I know, since the action for support is a personal action, the court order is enforceable against Diego if the court acquires jurisdiction over his person (like, there was valid service of summons). But just the same, Diego may question the Ruling on the ground that he is already an american citizen and that laws relating to family rights and duties are applicable only to citizens of the Philippines.

Under Philippine Law, the illegitimate child is entitled to one-half of the share of a legitimate child. However, with respect to the disposition of properties, ie. by will, the law of the state where the will is executed prevails. Thus, if the law of the state says that disposition of the property by will passes to the benificiary (children), then the illegitimate child here in the Phil. have no right over the properties transferred.

Bear in mind that laws relating to family rights and duties are binding upon citizens of the Philippines, even though living abroad. Thus, since Diego is an American citizen, i believe the philippine laws no longer apply to him with respect to his family rights and duties. But with respect to any property located in the Philippines, the Philippine law still applies.

There are certain requirements before you could validly file a petition for adoption depending upon your citizenship (if American Citizen, inter-country adoption will apply) and your relationship with the person to be adopted. Since you are both American citizens, the Inter-country Adoption Law shall apply.Under the said law, only a legally free child may be the subject of inter-country adoption. In order that such child may be considered for placement, the following documents must be submitted to the Board (Inter Country Adoption Board):

(a)Child study;
(b)Birth certificate/foundling certificate;
(c)Deed of voluntary commitment/decree of abandonment/death certificate of parents;
(d)Medical evaluation /history;
(e)Psychological evaluation, as necessary; and
(f)Recent photo of the child.

Who May Adopt. ? An alien or a Filipino citizen permanently residing abroad may file an application for inter-country adoption of a Filipino child if he/she:

(a) is at least twenty-seven (27) years of age and at least sixteen (16) years older than the child to be adopted, at the time of application unless the adopter is the parent by nature of the child to be adopted or the spouse of such parent:

(b) if married, his/her spouse must jointly file for the adoption;
(c) has the capacity to act and assume all rights and responsibilities of parental authority under his national laws, and has undergone the appropriate counseling from an accredited counselor in his/her country;

(d) has not been convicted of a crime involving moral turpitude;

(e) is eligible to adopt under his/her national law;

(f) is in a position to provide the proper care and support and to give the necessary moral values and example to all his children, including the child to be adopted;

(g) agrees to uphold the basic rights of the child as embodied under Philippine laws, the U.N. Convention on the Rights of the Child, and to abide by the rules and regulations issued to implement the provisions of this Act;

(h) comes from a country with whom the Philippines has diplomatic relations and whose government maintains a similarly authorized and accredited agency and that adoption is allowed under his/her national laws; and

(i) possesses all the qualifications and none of the disqualifications provided herein and in other applicable Philippine laws.

Where to File Application. ? An application to adopt a Filipino child shall be filed either with the Philippine Regional Trial Court having jurisdiction over the child, or with the Board, through an intermediate agency, whether governmental or an authorized and accredited agency, in the country of the prospective adoptive parents, which application shall be in accordance with the requirements as set forth in the implementing rules and regulations to be promulgated by the Board.
The application shall be supported by the following documents written and officially translated in English.
(a) Birth certificate of applicant(s);

(b) Marriage contract, if married, and divorce decree, if applicable;
(c) Written consent of their biological or adoptive children above ten (10) years of age, in the form of sworn statement;

(d) Physical, medical and psychological evaluation by a duly licensed physician and psychologist;

(e) Income tax returns or any document showing the financial capability of the applicant(s);

(f) Police clearance of applicant(s);

(g) Character reference from the local church/minister, the applicant's employer and a member of the immediate community who have known the applicant(s) for at least five (5) years; and

(h) Recent postcard-size pictures of the applicant(s) and his immediate family;

Aside from what Atty Erick stated the most important requirement is you have to live with the child for at least two years. That is the hardest requirement to meet. One of my townmates has to go home and stay in the Philippines for two years just to meet this requisite. If the child is orphaned, it might be a different story.
